Cancel A Timeshare

More often than not, timeshare owners are looking for any and every way to cancel a timeshare and get out of their debt. However, the process of canceling a timeshare, and even simply being able to, is a lot more convoluted than people expect it to be. You would never expect that when you received a letter in the mail about free airplane tickets that a little down the line you would be wondering, “Are my kids responsible for my timeshare,” and if so, how can you get them out.

Now you find yourself in possession of a timeshare that you don’t want as you realize one of a number of problems. First of all, maybe your career or family won’t allow for you to just pick up every year to go on some far off vacation, or maybe you finally realized that there are a lot of hidden costs that the timeshare resale companies didn’t tell you about and you do not have that kind of money, or finally, perhaps you just simply do not want to go to the same place each year in and out. Where is there to go now though, after the contract has already been signed and everything? Fortunately, there are still several steps that can be taken to get you to that timeshare freedom you seek.

For starters, let us begin by trying what is definitely the first possible way to cancel a timeshare contract. Most timeshare owners actually have what is referred to as a rescission period. Basically, because the timeshare industry insiders know that these are often impulse decisions, they allow for you to cancel the contract with no strings attached as long as it is within a certain time period from the date of the contract signing. This is usually in between three and fifteen days and usually is about seven to ten. So, if you are within your rescission period as it is called, you can simply call the company from which you purchased your timeshare back and simply tell them that you wish to render the contract null and void. If you are one of the rare and lucky few to have actually caught the opportunity to get out of time share weeks this early then congratulations are in order because you are on your way to becoming timeshare free.

However, for some of us, it is almost never this easy. In actuality, it is rather difficult to catch the mistake in your timeshare contract that early on and also know that you can call during the rescission period (they usually don’t tell you about) and cancel the contract with or without the aid of timeshare lawyers. If you are one of us who is not so familiar with that particular timeshare law but do still want to cancel your timeshare contract, there are still a couple of options. First, some people try to just call their timeshare retailer and ask them if they would buy back the great bargain they sold them at half the price. But, as you probably guessed, this is highly unlikely to get you out of your timeshare contract.

If the timeshare company still does not buy back your timeshare contract, unfortunately you do not have the right to cancel timeshare contract unless you can prove that they sold it to you somehow illegally. If you can, then you can report the case to your local state Attorney General’s Office and if enough of your fellow timeshare owners complain against the same company in your state, you may be able to get a class action lawsuit against them and eventually cancel your timeshare. This will not get you a reimbursement on your timeshare though and it usually takes a great deal of effort and time to prove a timeshare scam.
